1. Definitions

In these Terms and Conditions, the following terms carry the meanings set out below:

• "Agreement" means these Terms and Conditions as updated from time to time.
• "Service" means the financial education programs, website, and related support provided by Garuda Wealth.
• "User" / "You" means any individual accessing our website or enrolling in a program.
• "We" / "Us" / "Our" means Garuda Wealth, 412 Rama IV Road, Khlong Toei, Bangkok 10110, Thailand.
• "Content" means all written materials, course modules, exercises, and documents provided through our programs.
• "Program" means any of the three financial education courses offered by Garuda Wealth.

2. Acceptance of Terms

By accessing our website or enrolling in a program, you confirm that you have read, understood, and agree to be bound by this Agreement. You must be at least 18 years of age and legally capable of entering into a binding agreement to use our services. If you do not agree with any part of these terms, you should not enrol in or access our programs.

3. Service Description

Garuda Wealth provides self-paced financial education programs designed for adults in Thailand. Programs are delivered in English and cover debt management, savings rebuilding, and long-term financial planning and recovery. Program content is updated annually but is provided for educational purposes only — it does not constitute regulated financial, legal, or investment advice.

Services are available to individuals in Thailand. We do not currently guarantee availability in all regions or from all network environments.

4. Enrolment and Account

• Enrolment is completed by submitting a programme enquiry, confirming acceptance of these terms, and completing payment of the programme fee.
• You are responsible for maintaining the confidentiality of any access credentials we provide.
• You must provide accurate information at enrolment. Inaccurate information may result in cancellation of access.
• Program access begins upon receipt of confirmed payment and programme confirmation from us.

5. User Responsibilities

• You agree to use our programs and website for lawful, personal educational purposes only.
• You must not share, redistribute, sell, or reproduce any program content without our express written permission.
• You must not attempt to circumvent any access controls or use our content in a manner that infringes our intellectual property rights.
• You agree to engage with program materials respectfully and to treat any mentor, instructor, or support staff with courtesy.

6. Intellectual Property

All program content, course materials, and documents created by Garuda Wealth are our intellectual property and are protected by Thai and applicable international copyright law. You are granted a limited, non-exclusive, non-transferable licence to access and use program materials for your own personal educational purposes during the programme period. You may not copy, distribute, translate, or create derivative works from our content without explicit written permission.

7. Payment Terms

• All fees are denominated and payable in Thai Baht (THB).
• Payment must be completed before programme access is granted.
• Accepted payment methods are communicated during the enrolment process.
• Fees are inclusive of all program materials and support access as described for each programme on our website.

Refund Policy

• Withdrawal requests received within fourteen (14) days of programme start may be eligible for a partial refund at our discretion, subject to review of materials accessed.
• Requests submitted after fourteen days are generally not eligible for refund.
• In exceptional circumstances (serious illness, bereavement), we will review withdrawal requests on their individual merits.

8. Programme-Specific Terms

Each programme has a defined duration: 6 weeks (Debt), 10 weeks (Savings), or 15 weeks (Long-View). Programme materials remain accessible to enrolled learners for the duration of their programme plus 30 days following the final week. Mentor conversations (Long-View only) must be scheduled within the programme period. Unused mentor conversations do not roll over.

9. Disclaimers

Garuda Wealth provides financial education — not regulated financial advice. Programme content is intended to help you understand financial concepts and develop personal decision-making frameworks. It does not constitute advice to buy, sell, or hold any financial product, nor legal advice of any kind.

While we take care to ensure programme accuracy, we make no representation that any financial decision made by a learner as a result of completing a programme will achieve a particular outcome. Financial situations vary and depend on individual circumstances.

Programme content is provided "as is" for educational purposes. We do not warrant that the website will be uninterrupted or error-free at all times.

10. Limitation of Liability

To the extent permitted by Thai law, Garuda Wealth's total liability to any User for any claim arising from use of our services shall not exceed the total programme fee paid by that User. We shall not be liable for indirect, consequential, or incidental losses arising from use of our programmes or website.

11. Indemnification

You agree to indemnify and hold harmless Garuda Wealth, its staff, and instructors from and against any claims, losses, or expenses (including reasonable legal costs) arising from your breach of this Agreement or your misuse of our services.

12. Termination

We reserve the right to suspend or terminate programme access if a User breaches these terms, engages in abusive conduct toward staff, or uses programme content in an unauthorised manner. In cases of termination for breach, fees are not refunded. Users may withdraw from a programme at any time; refund eligibility is as described in Section 7.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage informal resolution by contacting us at [email protected] in the first instance. If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the competent courts of Bangkok, Thailand.

14. General Provisions

• Entire Agreement: This Agreement constitutes the complete agreement between you and Garuda Wealth with respect to our services.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under this Agreement to any third party without our written consent.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above and, for material changes, notify enrolled learners by email. Continued use of our services after an update constitutes acceptance of the revised terms.
